“EPS,’95 formulated for the poorer sections of the workers”
“Is this statement correct?”
As per the recent article published in The Hindu, the Central Provident Fund Commissioner stated that EPS,’95 is essentially meant for the poorer sections of the workforce. This is the narrative coming from EPFO which is a recent development in the context of the demand for Higher Pension.
This narrative was not there when the Scheme was unveiled in Parliament in 1995. Nor was it mentioned in the Judgment by Hon’ble Supreme Court which upheld the Scheme on 11th November, 2003. It was also not there when a Press Statement was released in all leading News Papers of the country on 5th January, 1996 (more than 30 years back) to clear misconceptions about the scheme.
Even the Hon’ble High Court of kerala while striking down the amendments through its judgement on 12th October, 2018 stated as follows:
” The further contention that the ceiling limit was intended to cater to the “lower wage earners” also has to be rejected for the reason that no such intention is discernible from the provisions of the Act. (Page No. 70)”
The above judgement was also upheld by the Hon’ble Supreme Court on 1st April, 2019. Unfortunately for “other reasons” the above judgement was recalled.
If the Scheme is really meant for poorer sections of the workforce, provison of Higher Pension would not have been announced on the floor of Parliament on 28th of February, 1996 to pacify the agitating employees to make them acceptable to the scheme.
Employees’ Pension Scheme, 1995 is improvement over Employees’ Family Pension Scheme, 1971 (01-03-1971 to 15-11-1995). The contribution of 1.16% from employee which was there in EFPS,’71 was dropped. The Employers’ Contribution enhanced from 1.16% to 8.33% and the Government contribution remained @ 1.16% when compared with EFPS,’71.
During the operation of EFPS,’71 for about 24 years, 8 months and 15 days, there was never any statement that the scheme is formulated to cater to the welfare of the nominee of the poorer sections of the workforce when the breadwinner dies while in service.
In fact the first ceiling under EFPS,’71 which was 1,000/- (31-12-1962 to 10-12-1976) from 01-03-1971 to 10-12-1976 was much more than the Minimum Wages (Pay+D.A.) of the Central Government employees as per the Second Central Pay Commission (01-07-1959 to 31-12-1972) Scales.
As per Page No. 37 of the report of the Third Central Pay Commission (01-01-1973 to 31-12-1985), the total Pay+D.A. of the last Grade employee of Central Government as on 01-01-1972 (ten months after implementation of EFPS,’71 w.e.f. 01-03-1971) was 170/- i.e., Pay: 70/- and D.A. 100/-
including Dearness Pay, first, second, third interim reliefs announced pending implementation of the scales of Third Central Pay Commission. Including D.A. as on 01-01-1972.
1,000/- Ceiling which was prevailing on 01-01-1972 is 5.88 times to 170/-. Then how can one say that EPS,’95 is meant for poorer sections of workforce when EPS,’95 is off-shoot of EFPS,’71.
Further the Ceiling of 5,000/- which was implemented from 01-10-1994 under EFPS,’71 was continued when EPS,’95 was introduced and prevailing upto 31-05-2001.
Even the 5,000/- which was the Ceiling when EPS,’95 is implemented is much more than 750/- beginning Basic Pay of Central Government employee as per Fourth Central Pay Commission (01-01-1986 to 31-12-1995) with D.A. of 136% as on 01-07-1995. I.e., total Minimum Pay+D.A. is 750/-+1,020/- (136% of 750/-) which comes to 1,770/-. 5,000/- Ceiling is 2.82 times of 1,770/-.
Further 2,550/- is the least Basic Pay with Nil D.A. as on 01-01-1996 as per Fifth Central Pay Scales (01-01-1996 to 31-12-2005) when the Ceiling is 5,000/- under EPS,’95 as on 01-01-1996. Hence also the Ceiling is 1.96 times more.
Hence the argument that EPS,’95 is meant for poorer sections of the workforce is baseless.

“ఈ ప్రకటన సరైనదేనా?”
‘ది హిందూ’ పత్రికలో ఇటీవల ప్రచురితమైన కథనం ప్రకారం, EPS, ’95 ప్రధానంగా కార్మిక వర్గంలోని పేద వర్గాల కోసమే ఉద్దేశించబడిందని సెంట్రల్ ప్రావిడెంట్ ఫండ్ కమిషనర్ పేర్కొన్నారు. అధిక పింఛను కోసం వస్తున్న డిమాండ్ నేపథ్యంలో, EPFO నుండి వస్తున్న ఈ వాదన ఇటీవలి పరిణామం.
1995లో పార్లమెంటులో ఈ పథకాన్ని ఆవిష్కరించినప్పుడు ఈ వాదన లేదు. 2003 నవంబర్ 11న ఈ పథకాన్ని సమర్థించిన గౌరవనీయ సుప్రీంకోర్టు తీర్పులో కూడా దీని ప్రస్తావన లేదు. ఈ పథకంపై ఉన్న అపోహలను తొలగించడానికి 1996 జనవరి 5న (30 ఏళ్లకు పైగా క్రితం) దేశంలోని అన్ని ప్రముఖ వార్తాపత్రికలలో పత్రికా ప్రకటన విడుదల చేసినప్పుడు కూడా ఇది లేదు.
గౌరవనీయ కేరళ హైకోర్టు కూడా, 12 అక్టోబర్, 2018న తన తీర్పు ద్వారా సవరణలను కొట్టివేస్తూ ఈ క్రింది విధంగా పేర్కొంది:
“చట్టంలోని నిబంధనలలో అటువంటి ఉద్దేశం ఏదీ కనిపించనందున, గరిష్ట పరిమితిని ‘తక్కువ వేతన కార్మికుల’ ప్రయోజనం కోసం ఉద్దేశించారనే వాదనను కూడా తిరస్కరించాలి. (పేజీ నెం. 70)”
పై తీర్పును గౌరవనీయ సుప్రీంకోర్టు కూడా 1 ఏప్రిల్, 2019న సమర్థించింది. దురదృష్టవశాత్తు ‘ఇతర కారణాల’ వల్ల పై తీర్పును ఉపసంహరించుకున్నారు.
ఈ పథకం నిజంగా కార్మిక వర్గంలోని పేద వర్గాల కోసమే ఉద్దేశించినట్లయితే, ఆందోళన చేస్తున్న ఉద్యోగులను శాంతింపజేసి, వారిని ఈ పథకానికి అంగీకరించేలా చేయడానికి, 28 ఫిబ్రవరి, 1996న పార్లమెంటులో అధిక పింఛను నిబంధనను ప్రకటించి ఉండేవారు కాదు.
ఉద్యోగుల పింఛను పథకం, 1995 అనేది ఉద్యోగుల కుటుంబ పింఛను పథకం, 1971 (01-03-1971 నుండి 15-11-1995 వరకు) కన్నా మెరుగైనది. EFPS, ’71లో ఉద్యోగి చెల్లించే 1.16% వాటాను తొలగించారు. EFPS, ’71తో పోలిస్తే యజమానుల వాటా 1.16% నుండి 8.33%కి పెరిగింది మరియు ప్రభుత్వ వాటా 1.16% వద్దే స్థిరంగా ఉంది.
సుమారు 24 సంవత్సరాల, 8 నెలల, 15 రోజుల పాటు EFPS, ’71 అమలులో ఉన్న కాలంలో, ఉద్యోగంలో ఉండగా కుటుంబ పోషకుడు మరణించినప్పుడు, కార్మిక వర్గంలోని పేద వర్గాల నామినీ సంక్షేమాన్ని చూసుకోవడానికి ఈ పథకం రూపొందించబడిందని ఎన్నడూ ఎలాంటి ప్రకటన చేయబడలేదు.
వాస్తవానికి, EFPS, ’71 కింద మొదటి గరిష్ట పరిమితి అయిన రూ. 1,000/- (31-12-1962 నుండి 10-12-1976 వరకు) 01-03-1971 నుండి 10-12-1976 వరకు, రెండవ కేంద్ర వేతన సంఘం (01-07-1959 నుండి 31-12-1972) స్కేళ్ల ప్రకారం కేంద్ర ప్రభుత్వ ఉద్యోగుల కనీస వేతనాల (వేతనం+డి.ఏ.) కంటే చాలా ఎక్కువగా ఉండేది.
మూడవ కేంద్ర వేతన సంఘం (01-01-1973 నుండి 31-12-1985) నివేదికలోని 37వ పేజీ ప్రకారం, మొత్తం వేతనం+డి.ఏ. 01-01-1972 నాటికి (01-03-1971 నుండి అమలులోకి వచ్చిన EFPS, ’71 అమలు జరిగిన పది నెలల తర్వాత) కేంద్ర ప్రభుత్వ చివరి గ్రేడ్ ఉద్యోగి జీతం 170/- రూపాయలు, అనగా జీతం: 70/- మరియు డి.ఏ. 100/-.
ఇందులో కరువు భత్యం, మూడవ కేంద్ర వేతన సంఘం స్కేళ్ల అమలు జరిగే వరకు ప్రకటించిన మొదటి, రెండవ, మూడవ మధ్యంతర ఉపశమనాలు కూడా కలిపి ఉన్నాయి. 01-01-1972 నాటి డి.ఏ.తో సహా.
01-01-1972 నాటికి అమలులో ఉన్న 1,000/- గరిష్ట పరిమితి, 170/- రూపాయలకు 5.88 రెట్లు. అలాంటప్పుడు, EPS, ’95 అనేది EFPS, ’71 యొక్క ఉప ఉత్పత్తి అయినప్పుడు, అది కార్మిక వర్గంలోని పేద వర్గాల కోసం ఉద్దేశించబడిందని ఎలా చెప్పగలరు?
అంతేకాకుండా, EFPS,’71 కింద 01-10-1994 నుండి అమలు చేయబడిన రూ. 5,000/- గరిష్ట పరిమితి, EPS,’95 ప్రవేశపెట్టినప్పుడు కూడా కొనసాగించబడింది మరియు 31-05-2001 వరకు అమలులో ఉంది.
EPS,’95 అమలు చేసినప్పుడు గరిష్ట పరిమితిగా ఉన్న రూ. 5,000/- కూడా, 01-07-1995 నాటికి నాల్గవ కేంద్ర వేతన సంఘం (01-01-1986 నుండి 31-12-1995 వరకు) ప్రకారం 136% డి.ఏ.తో కూడిన కేంద్ర ప్రభుత్వ ఉద్యోగి యొక్క ప్రారంభ మూల వేతనం రూ. 750/- కంటే చాలా ఎక్కువ. అనగా, మొత్తం కనీస వేతనం+డి.ఏ. రూ. 750/-+1,020/- (750/-లో 136%) అవుతుంది, ఇది రూ. 1,770/-కు సమానం. రూ. 5,000/- గరిష్ట పరిమితి అనేది రూ. 1,770/-కు 2.82 రెట్లు.
ఇంకా, ఐదవ కేంద్ర వేతన స్కేలు (01-01-1996 నుండి 31-12-2005 వరకు) ప్రకారం, 01-01-1996 నాటికి డి.ఏ. (D.A.) ఏమీ లేకుండా ఉన్న కనీస బేసి వేతనం 2,550/- కాగా, 01-01-1996 నాటికి ఈపీఎస్,’95 కింద గరిష్ట పరిమితి 5,000/-గా ఉంది. అందువల్ల, గరిష్ట పరిమితి కూడా 1.96 రెట్లు ఎక్కువగా ఉంది.
అందువల్ల, ఈపీఎస్,’95 కార్మికవర్గంలోని పేద వర్గాల కోసమే ఉద్దేశించబడింది అనే వాదన నిరాధారమైనది.
