“Denial of Higher Pension quoting Exempted Trust rules”

EPFO rejecting options for Higher Pension incase of the beneficiaries of the Hon’ble Supreme Court judgement of 4th November, 2022, enmass, exempted establishment wise and even moving Hon’ble Supreme Court, it seems as per news paper reports against the favourable judgements of Hon’ble High Courts in this regard.

But to win the case (4th November, 2022), it quoted ashtronomical amount as deficit if Higher Pension is allowed to post 01-09-2014 reitrees and working employees. If filed in this connection a first affidavit, quoting 92,55,580 employees as on 31-03-2017 from Exempted Establishments as eligible for Higher Pension vide Page No. 410. This figure was submitted to the Hon’ble Supreme Court after thoroughly verifying the Exempted Trust rules, it must be assumed because the submission is to the Highest Court of the Country, i.e., Hon’ble Supreme Court.

When about 15 employees from Bharat Dynamic Limited, Hyderabad asked for break-up for the above 92,55,580 Exempted Establishment wise through RTI at my suggestion, EPFO first replied that it is to be obtained from other Divisions of the EPFO first. But within no time it wrote a second letter, that the said information is not avaialble “in the format”. The above 15 employees only asked for break-up and not in any prescribed format. But to evade the responsibility as per the RTI act, EPFO replied that the information is not available in the format.

This is a clear case of escape by EPFO as far as RTI act in concerned. Therefor it is my sincere advice to all the retirees, employees in whose case Exempted Trust rules came in the way of sanctioning Higher Pension to raise “individual” RTI quaries in this regard and flood the EPFO with the above letters in lakhs so that EPFO may come to its knees and sanction Higher Pension.

Moreover, in every Exempted Establishment, there are two types of optees for Higher Pension. For example, in Visakhapatnam Steel Plant there are employees

1) who opted for Higher Pension as per the Gazette Notification of 16th March, 1996.
2) who opted as per the judgement of 4th November, 2022.

Employees in case of (1) are already drawing Higher Pension. In their case Exempted Trust rules not came in the way.

But in case of (2) Exempted Trust rules are coming in the way.

Further in the same Exempted Establishment (Visakhapatnam Steel Plant as example).

This also is to be questioned through RTI by every effected employee.
