Dear Members,

The SLP challenging the judgment (pre-2014 case) of Punjab & Haryana High Court by EPFO was listed today in Court no 3 of the Supreme Court. Mr Sidhartha, AoR appeared for EPFO/Petitioner. The respondent (un-from exempted establishment) side was represented by Mr Gopal Shankaranarayan, Sr. Advocate and ROWS side (as a caveator) was represented by Mr. Udayditya Banerjee, AOR.

After listening all the parties, the court issued a Notice to be responded to by the Respondents within four weeks and thereafter a counter affidavit by the Petitioner within two weeks. The Matter is to be listed upon expiry of the prescribed time.

Since the SLP was filed against only one writ petition, the Court, while issuing notice, stayed the contempt proceedings, if any, initiated by any Respondents before the Court. The court did not agree with the request of EPFO/Petitioner to stay the HC judgment.

The Court also granted liberty to third parties such as ROWS, to file the Replies in the form of Impleadment/intervention Applications.

Yes, filing of Caveat was necessary for protecting the pre-retirees already getting higher pension.

Further, we met on 27th September along with Sh Parveen KohliJi at the Chamber of our AOR Sh. Purushottam Sharma TripathiJi. Mr. Kohli Sahib has cleared the points to be taken in this case & our case. We were suggested to hold for the outcome of this case to see the mood of new judges.
Now, we’ll again talk with both AOR & Mr Kohli Sahib and then move accordingly.

प्रिय सदस्यों,

पंजाब एवं हरियाणा उच्च न्यायालय के निर्णय (2014 से पूर्व का मामला) को चुनौती देने वाली ईपीएफओ द्वारा दायर विशेष अनुमति याचिका आज सर्वोच्च न्यायालय की अदालत संख्या 3 में सूचीबद्ध की गई। ईपीएफओ/याचिकाकर्ता की ओर से श्री सिद्धार्थ, एओआर उपस्थित हुए। प्रतिवादी (छूट प्राप्त प्रतिष्ठान से बाहर) पक्ष का प्रतिनिधित्व श्री गोपाल शंकरनारायण, वरिष्ठ अधिवक्ता ने किया और आरओडब्ल्यूएस पक्ष (एक कैविएटर के रूप में) का प्रतिनिधित्व श्री उदयदित्य बनर्जी, एओआर ने किया।

सभी पक्षों को सुनने के बाद, न्यायालय ने प्रतिवादियों को चार सप्ताह के भीतर जवाब देने के लिए एक नोटिस जारी किया और उसके बाद याचिकाकर्ता को दो सप्ताह के भीतर एक प्रति-शपथपत्र प्रस्तुत करना था। निर्धारित समय सीमा समाप्त होने पर मामले को सूचीबद्ध किया जाएगा।

चूँकि विशेष अनुमति याचिका केवल एक रिट याचिका के विरुद्ध दायर की गई थी, इसलिए न्यायालय ने नोटिस जारी करते हुए, न्यायालय के समक्ष किसी भी प्रतिवादी द्वारा शुरू की गई अवमानना कार्यवाही, यदि कोई हो, पर रोक लगा दी। अदालत ईपीएफओ/याचिकाकर्ता द्वारा उच्च न्यायालय के फैसले पर रोक लगाने के अनुरोध से सहमत नहीं हुई।

अदालत ने आरओडब्ल्यूएस जैसे तृतीय पक्षों को कार्यान्वयन/हस्तक्षेप आवेदनों के रूप में जवाब दाखिल करने की भी स्वतंत्रता प्रदान की।
