On 17.08.2021, a Hearing started in the Supreme Court on Eps 95 pensioners case at New Delhi.
Arguments have started at about 12.10 PM in the Afternoon.
The Senior Advocate Mr. Aryama Sundaram has presented his arguments on behalf of EPFO.
He started quoting Kerala High Court Judgement, which dealt about employees (Rtd) who contributed under EPF Scheme, however, not under section 11(3)

1] Only an Employee can submit the option and not a Retiree
2] Option on retrospective, not acceptable
3] Maximum contribution is limited to Rs. 15 K
4] EPFO ‘s amendment under sec. 609 E is very much valid wef

5] Only 8.33 % will be added to the pension fund and the balance will
remain with Exempted Trust Fund
6] EPFO can not continue with the scheme, as the involved amount on higher pension is enormous to the level of 15.28 lakh Crores.
7] Options under section.26(6), 11(3) & amendment 11(4) can not on a retrospective basis but limited to prospective
8] RC Gupta case decision can not be applicable to retirees, of Exempted
9] Similarly, Pawan Hans case decision is applicable prospectively and can not be on retro basis
10] Actuarial Report is in support of EPFO

Eps 95 pensioner Advocates have answers to submit to Court
For all the above questions, there are answers on Eps 95 pensioners’ side.
The above questions were raised in all the High courts of many States on behalf of EPFO. But they have lost their cases in all the High courts.
There is no wonder that the same points were also put before the Supreme Court to confuse the Court.
Tomorrow, on 18.08.2021, the EPFO side presentation may be over, and thereafter the Advocates on the Eps 95 pensioners side may get the opportunity to present their points.

130 minutes of hearing of our cases today. Total time used by Nr. Sundaram EPFO Sr, Advocate next hearing on 24.08.21
Justice Lalit has asked the opinion of Sr Advocates regarding the transfer of our cases to 3 judges bench.
Sr Advocate informed that RC. Gupta case order implemented by the Government and review filed on that.
Hence, our cases can continue in 2 judges’ bench.
Justice Lalit mentioned that he will discuss this & issue an order in case transfer to 3 judges bench is approved.
Mr. Sundaram has missed the judges today with one example of >1 lakh pension, Nakaria case non-applicability, cut off date is for availing the opinion, not for eligibility of Rs. 6500 salary, transfer of funds from EPF to EPS not possible, a retrospective effect not possible, etc.

EPFO తరఫున సీనియర్ న్యాయవాది శ్రీ ఆర్యమ సుందరం తన వాదనలు వినిపించారు.

రేపు, 18.08.2021 న, EPFO సైడ్ ప్రెజెంటేషన్ ముగిసి ఉండవచ్చు, ఆ తర్వాత Eps 95 పెన్షనర్ల వైపు న్యాయవాదులు తమ పాయింట్లను సమర్పించే అవకాశాన్ని పొందవచ్చు.
