The Supreme Court reserves its decision on Employees Provident Fund Organisation’s appeal. The details are here.

The Supreme Court reserved its order on appeals by the EPFO  challenging the decisions of the Kerala, Rajasthan, and Delhi High Courts that struck down the Employees’ Pension (Amendment) Scheme, 2014.

A three-judge bench of 1) Justice Uday Umesh Lalit, 2) Justice Aniruddha Bose, and 3) Justice Sudhanshu Dhulia reserved the decision after a hearing for six days.

In 2018, the Kerala High Court quashed the Employees’ Pension (Amendment) Scheme, 2014 [2014 Amendment Scheme] allowing payment of pension in proportion to the salary exceeding the limit of Rs 15,000 per month.  

The High Court also said that there can be no cut-off date for joining the pension scheme.

The Supreme Court had in 2019 dismissed the special leave petition filed by the EPFO ​​against the Kerala High Court’s decision.  

Later, in a review sought by the Employees Provident Fund Organisation  ​​and the Central Government, the order of dismissal of the Special Leave Petition was withdrawn and the matter was reopened for hearing on merits.

 In August 2021, a 2-judge bench of the Supreme Court referred the appeals to a three-judge bench to consider the following issues:

 1. Whether there will be any cut-off date under paragraph 11(3) of the Employees’ Pension Scheme and

 2. Whether the principles laid down in RC Gupta Vs. R.P.F Commissioner (2016) will apply on the basis of which all these cases should be disposed of.

 The main argument raised by the Employees Provident Fund Organisation  ​​is that Pension Fund and Provident Fund are separate and membership of the latter will not automatically translate into membership of the former.  

It was argued that the pension scheme is meant for underage employees and if persons earning salaries above the cut-off limit are also allowed to receive a pension, it would create a huge imbalance within the fund.  The 2014 amendments were brought to address the issue of cross-subsidy between pension and provident fund.

The pensioners rejected the argument of the financial burden being borne by the EPFO.  It was argued by them that the corpus fund was intact and the payment was made out of interest.  Pensioners also rejected EPFO’s contention that a separate option should be exercised within the cut-off period to join pension scheme and argued that EPFO’s stand is contrary to law
