Sub.: Complaint against the concerned officers of Legal Division, EPFO, HQ for violation of Section 166 of IPC and Contempt of the orders dt. 12.07.2016 (Austin Joseph case) & dt. 4.10.2016 (RC Gupta case) of Hon’ble Supreme Court of India
Respected Sir,
This complaint is being filed by the Haryana Tourism Retired Officers Welfare Association (HTROWA), through its President against the concerned officers of the Legal Division, EPFO, HQ for violation of Section 166 of IPC and Contempt of the orders dt. 12.07.2016 (Austin Joseph case) & dt. 4.10.2016 (RC Gupta case) of Hon’ble Supreme Court of India by circulating unlawful directive dated 16.09.2020 to ZOs/ROs by exceeding their authority; contents of which are Contemptuous of the clear orders of Hon’ble SC and in defiance/ contravention of the approvals dated 19.12.2016 and 16.3.2017 accorded by the competent authority i.e. CBT & MoL&E respectively wherein it has been unlawfully directed to reject the cases of those pensioners who had not submitted Joint Option under Para 11(3) of EPS’95 DURING THEIR SERVICE TENURE even if they had contributed towards PF on higher salary as per Para 26(6) of the EPF Scheme, 1952 and the PF was being managed by EPFO. Since internally, officers of the Legal Division know it very well that their action is wrong (as being done with some hidden agenda); that is why the said directive dt. 16.9.2020 is silent regarding the Circular dt. 23.3.2017 issued by the Pension Division with the required approvals accorded by the Competent Authority (as stated above).
The complaint has been filed based on official records obtained under RTI Act from the o/o EPFO HQ, EPFO field offices particularly ZO/RO Chandigarh and MoL&E from time to time.
A signed copy of aforesaid complaint (40 pages) is attached along with some of the documents for ready reference with a request to immediately take necessary action in the matter so that we may not have to approach the doors of Supreme Court for Contemptuous action by the officers of Legal Division without any rhyme or reason.

ఈ ఫిర్యాదును హర్యానా టూరిజం రిటైర్డ్ ఆఫీసర్స్ వెల్ఫేర్ అసోసియేషన్ (హెచ్‌టిరోవా) తన అధ్యక్షుడు ద్వారా లీగల్ డివిజన్, ఇపిఎఫ్‌ఓ, హెచ్‌క్యూ సంబంధిత అధికారులపై ఐపిసి సెక్షన్ 166 ను ఉల్లంఘించినందుకు మరియు ఉత్తర్వులను ధిక్కరించినందుకు.
12.07.2016 తేది (ఆస్టిన్ జోసెఫ్ కేసు) & గౌరవ సుప్రీంకోర్టు యొక్క 4.10.2016 తేది (ఆర్.సి. గుప్తా కేసు) 16.09.2020 నాటి చట్టవిరుద్ధమైన ఆదేశాన్ని ZO లు / RO లకు వారి అధికారాన్ని మించి ప్రసారం చేయడం ద్వారా; వీటిలో విషయాలు గౌరవనీయమైన ఎస్సీ యొక్క స్పష్టమైన ఉత్తర్వులను మరియు 19.12.2016 మరియు 16.3.2017 నాటి ఆమోదాలను ధిక్కరించడం / ఉల్లంఘించడం వంటివి సమర్థ అధికారం ద్వారా ఇవ్వబడ్డాయి.
అంటే వరుసగా CBT & MoL & E, ఈ కేసులను తిరస్కరించాలని చట్టవిరుద్ధంగా ఆదేశించబడింది.
ఇపిఎస్ 95 యొక్క పారా 11 (3) కింద ఉమ్మడి ఎంపికను సమర్పించని పింఛనుదారులలో, వారి సేవా కాలం ప్రకారం, వారు ఇపిఎఫ్ పథకం, 1952 లోని పారా 26 (6) ప్రకారం అధిక జీతంతో పిఎఫ్ వైపు సహకరించినప్పటికీ, పిఎఫ్ EPFO చే నిర్వహించబడుతుంది.
అంతర్గతంగా, లీగల్ డివిజన్ అధికారులకు వారి చర్య తప్పు అని బాగా తెలుసు (కొన్ని దాచిన ఎజెండాతో చేసినట్లు); అందుకే చెప్పిన డైరెక్టివ్ dt. 16.9.2020 సర్క్యులర్ డిటి గురించి నిశ్శబ్దంగా ఉంది.
23.3.2017 పెన్షన్ డివిజన్ జారీ చేసిన కాంపిటెంట్ అథారిటీ (పైన పేర్కొన్న విధంగా) అవసరమైన ఆమోదాలతో జారీ చేసింది.
ఎప్పటికప్పుడు o / o EPFO HQ, EPFO క్షేత్ర కార్యాలయాలు, ముఖ్యంగా ZO / RO చండీగర్ మరియు MoL & E నుండి ఆర్టీఐ చట్టం క్రింద పొందిన అధికారిక రికార్డుల ఆధారంగా ఫిర్యాదు దాఖలైంది.
పైన పేర్కొన్న ఫిర్యాదు (40 పేజీలు) యొక్క సంతకం చేసిన కాపీ కొన్ని పత్రాలతో పాటు సిద్ధంగా రిఫరెన్స్ కోసం జతచేయబడింది, ఈ విషయంలో వెంటనే అవసరమైన చర్యలు తీసుకోవాలన్న అభ్యర్థనతో మేము సుప్రీంకోర్టు తలుపులను అపరాధ చర్య కోసం సంప్రదించాల్సిన అవసరం లేదు.
